1. Scope and Notice at Collection

This Privacy Policy explains how Kinstl collects, uses, retains, discloses, transfers, sells, shares, and otherwise processes information about users, visitors, leads, customers, contractors, and other individuals who interact with our websites, apps, APIs, communications, or services.

By interacting with Kinstl, you acknowledge the categories of personal information described below and the business and commercial purposes for which we collect, use, and disclose that information.

2. Categories of Information We Collect

  • Identifiers and contact data, such as name, email address, username, account identifiers, billing identifiers, and support communications.
  • Account and profile data, such as preferences, routines, habits, working styles, objectives, calendars, saved places, contacts you choose to import, and onboarding responses.
  • Planning and workspace content, such as tasks, events, notes, goals, constraints, messages, prompts, attachments, conversation history, assistant interactions, files, and generated outputs.
  • Location and movement data, including addresses, saved places, device-derived geolocation, route origin and destination data, commute patterns, and travel timing signals.
  • Commercial and payment data, such as subscription plan, billing status, invoices, transaction metadata, and payment-processor results. Full payment card numbers are generally handled by our processors rather than stored directly by us.
  • Internet, device, and usage data, such as IP address, browser type, device identifiers, cookies, session logs, pages viewed, clicks, referring URLs, crash logs, and performance telemetry.
  • Inferences and profiles, such as predicted routines, likely destinations, task priorities, scheduling tendencies, energy patterns, and product-interest segments generated from the information above.
  • Sensitive personal information where applicable, including precise geolocation, account credentials, calendar patterns, and other data that may reveal daily routines or highly personal context.

3. Sources of Information

We collect information directly from you, automatically from your devices and interactions, from service providers and business partners, from authentication and billing providers, from connected calendars or third-party integrations you authorize, and from public or licensed data sources.

We may also receive information from affiliates, purchasers or sellers in a transaction, advertising or analytics partners, and other third parties who lawfully provide it to us.

4. How We Use Information

  • Provide, operate, maintain, debug, protect, and support the Service.
  • Create plans, routes, assistant responses, recommendations, alerts, and other outputs.
  • Personalize interfaces, features, defaults, models, and user experience.
  • Train, tune, evaluate, benchmark, and improve models, prompts, workflows, analytics, and product features.
  • Generate aggregated, deidentified, synthetic, inferred, or statistical data products.
  • Process transactions, manage subscriptions, prevent fraud, enforce our contracts, and comply with law.
  • Send product, operational, transactional, security, and marketing communications.
  • Measure adoption, retention, engagement, conversion, and commercial opportunities.

5. Disclosure, Sharing, Sale, and Commercialization

We disclose information to service providers, contractors, hosting providers, analytics vendors, payment processors, routing and mapping providers, communication vendors, professional advisors, auditors, insurers, affiliates, and counterparties in connection with actual or proposed corporate transactions.

We may also disclose information to government authorities, regulators, courts, law enforcement, or private parties when we believe disclosure is reasonably necessary to comply with law, protect rights or safety, investigate misconduct, collect debts, or enforce our agreements.

In addition, we may now or in the future sell, license, rent, disclose, share, transfer, or otherwise monetize personal information, Derived Data, audience segments, usage insights, or other data sets, including for analytics, research, partnership, advertising, measurement, or data-product purposes, subject to applicable law and any opt-out rights you may have. This may include disclosures to affiliates, research partners, commercial counterparties, data-license recipients, ad-tech vendors, and other partners.

6. Sensitive Information and Profiling

Because Kinstl is a planning and routing product, we may process precise geolocation, routines, timing patterns, and other information that can be sensitive. We use this information to provide requested features, improve the Service, secure the product, and for other purposes described in this Policy.

We may use automated analysis and profiling to infer priorities, habits, likely routes, likely availability, and similar characteristics. Where applicable law gives you rights to limit or opt out of certain profiling or use of sensitive personal information, you may exercise those rights through the methods described in the Privacy Choices page.

7. Retention

We retain information for as long as reasonably necessary for the purposes described in this Policy, including providing the Service, maintaining records, resolving disputes, enforcing agreements, meeting legal obligations, improving models, and preserving business continuity.

Retention periods vary based on the nature of the information, how it is used, legal requirements, operational needs, and whether the information has been transformed into deidentified, aggregated, or derived forms.

8. Security and International Transfers

We use technical, organizational, and administrative measures designed to protect information, but no system is perfectly secure. You use the Service and transmit information at your own risk.

We and our providers may process information in the United States and other jurisdictions. By using the Service, you understand that your information may be transferred to and processed in jurisdictions that may not provide the same legal protections as your home jurisdiction.

9. Your Rights and Choices

Depending on where you live, you may have rights to access, know, correct, delete, port, appeal, limit certain uses of sensitive personal information, or opt out of the sale or sharing of personal information, targeted advertising, or certain profiling. Rights vary by jurisdiction and may be subject to verification, exceptions, and legal limitations.

California residents may have rights under the CCPA, as amended, including the rights to know, delete, correct, limit certain uses of sensitive personal information, opt out of sale or sharing, and not be discriminated against for exercising those rights. In jurisdictions where similar laws apply, equivalent rights may also be available.

10. Children

Kinstl is not directed to children under 18, and we do not knowingly intend the Service for them. If you believe a child provided us personal information in violation of this Policy, contact us and we will take appropriate steps.

11. Changes to This Policy

We may update this Privacy Policy from time to time. The updated version becomes effective when posted unless we state a later date. Material changes may be highlighted through the Service or by other notice methods where required by law.
